SB 1383 by Senator Hannah-Beth Jackson (D-Santa Barbara) would significantly expand employee leave in California. In the midst of a pandemic and economic turmoil, the measure would impact employers with five or more employees by mandating 12 weeks of leave each year for employees and threatens litigation for mistakes.
For employers with 50 or more employees, SB 1383 vastly expands the amount of protected leave an employee may take — up to a half a year — when state leave is combined with federal leave due to new definitions under the bill.
The bill also contains a private right of action where any misstep by an employer can lead to a costly lawsuit.
